Terms of Service

Agreement

These terms are an agreement between you and The House of Zavozina, LLC for use of SwoonPost (the website, the web app and the Chrome extension). By creating an account or using SwoonPost, you agree to them and to our Privacy Policy. If you use SwoonPost for a business, you confirm you have authority to accept these terms for that business.

Who can use SwoonPost

You must be at least 18 and use SwoonPost for a business or professional purpose. You are responsible for keeping your sign-in secure and for everything done through your workspace, including by people you invite.

Your content

You keep ownership of everything you add to SwoonPost. You give us a limited license to store, copy, process (including with AI), reformat, remove metadata from, and send your content, only to run SwoonPost for you. The license ends when you delete the content or close your account, apart from short-lived backups and copies the law requires us to keep.

Rights and permissions

You confirm that you have the rights to everything you upload, schedule or post through SwoonPost. That includes permission from photographers and other creators, the consent of people who appear in your photos and videos (such as clients, models and staff), and rights to any music. When you repost someone else's content, you are responsible for getting their permission and crediting them.

You approve every post

SwoonPost publishes only what a person on your account has reviewed and approved. You are responsible for what you approve, including checking AI drafts for accuracy and adding any disclosures the law or a platform requires, such as labels for paid partnerships or sponsored posts.

Google, Instagram and TikTok

SwoonPost connects to services we do not control. When you use them through SwoonPost, you also agree to their terms, including Google's Terms of Service, Instagram's Terms of Use and TikTok's Terms of Service. Those platforms can change or limit their features, rate limits or access at any time, and posting may fail or be delayed as a result. SwoonPost is not affiliated with, endorsed by, or sponsored by Google, Meta, Instagram or TikTok.

AI-generated suggestions

Captions, hashtags, schedules, brand voice profiles and coaching advice are produced with AI and may be inaccurate, incomplete or unsuitable. They are suggestions only. Results such as reach and engagement depend on the platforms and your audience, and we do not promise any particular result.

Acceptable use

You agree not to use SwoonPost to:

  • Post content that is illegal, infringing, deceptive, harassing or sexually explicit, or that breaks a platform's rules
  • Spam, buy or fake engagement, or run accounts you are not authorized to manage
  • Collect data from other people's accounts or scrape any platform
  • Interfere with, probe or reverse engineer SwoonPost, or get around its limits
  • Resell or give others access to SwoonPost without our written permission

Fees

SwoonPost is currently free for invited test users. If we introduce paid plans, we will show prices and terms before you are charged, and you can choose not to subscribe.

Suspension and closing your account

You can stop using SwoonPost and close your account at any time. We may suspend or close an account that breaks these terms, puts other users or the platforms at risk, or that we are legally required to close. Where we can, we will give notice and a chance to download your content first.

Disclaimers

SwoonPost is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that SwoonPost will be uninterrupted, error-free, or that any post will publish on time.

Limitation of liability

To the fullest extent the law allows, The House of Zavozina, LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim related to SwoonPost is limited to the greater of the amount you paid us in the 12 months before the claim or US $100.

Indemnity

You agree to defend and indemnify The House of Zavozina, LLC against claims arising from your content, your posts, or your breach of these terms or of a platform's rules.

Governing law and disputes

These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Davidson County, Tennessee, and both sides consent to their jurisdiction.

Changes to these terms

We may update these terms. We will post the new version here with a new effective date and tell you about material changes in the app or by email at least 14 days before they apply. Continuing to use SwoonPost after that means you accept the update.
